Can a house be sold if an unapproved sauna stands close to the plot boundary?
Question, anonymised: A house is being prepared for sale. There is a small sauna on piles, without a conventional foundation and without completed construction approval. A project has been submitted, but approval may be difficult because of its distance from the boundary. How should the property be valued and sold?
Answer: A sale is still possible, and it is sensible to clarify the documents before marketing. First establish the legal and factual status of the sauna: its size, construction, whether it can be moved without dismantling, and whether it is treated as a structure requiring a notice or permit. This should be checked against the actual project and municipal guidance rather than assumed.
Secondly, the boundary issue may sometimes be resolved with the neighbour’s written consent, provided the fire-safety distances between buildings are also met. It is worth discussing this route with the designer and the municipality before assuming that an application will be refused.
The key in a sale is full, clear disclosure: what is known, what has been filed, what remains unresolved and what documents the buyer receives. That lets the buyer make an informed decision and protects the seller from presenting the situation inaccurately.
